Thank you.

Please fwd Synopsis of your case in the format below at, vakeelkanumberdotcom@gmail.com.

The Synopsis should be as far as possible, be confined to in two A-4 Sized pages.

Instructions for Synopsis:
1.      Chronology of events (date wise; and where the time is of relevance, time-wise) that has led to the present situation of grievance.

2.      You need to mention in very brief as what has happened on each of relevant dates; i.e. state bare facts, and do not state your “views” on the facts.

3.      The “absence to act” by your adversary on a given situation, would also be a material fact. Like for example, you record a letter / notice / communiqué to your adversary, and your adversary does not reply to the same; or having regard to the fact situation, where the adversary is expected to respond or react to the fact situation, and he chooses to remain silent. Like for example, the cheque given by your adversary is dishonoured on presentation. Ordinarily, every prudent person would be concerned if the cheque given by him is dishonoured; and would react by calling the “payee”. Payee is the person in whose favour the cheque is drawn. The silence of the drawer of the cheque thus leads him to the culpability of the offence.

4.      If you are relying on any document, the substance of the document may be stated herein.

5.      If the query is concerning any judicial proceedings, then details of what has transpired on the litigation (You need to mention, very briefly, as what has transpired so far at each of the stage of the litigation)

Mumbai Capital Value Property Tax Judgment: A Rocket Science by Social Scientists; A Brief Analysis;

The subject of taxation is a “Rocket Science”. The constitution of Nine Judges Bench in the Mafatlal Industries Case, Reported in (1997) 5 SCC 536, running into more than 500 pages; the extremely contested Vodafone litigation; and the present Judgment of Bombay High Court running into 310 Pages, at least furnishes some justification to this statement of Rocket Science. There are umpteen Judgments, some of which are relied herein also (Para 147), that whilst dealing with challenge to Taxation laws, greater latitude is shown by Constitutional Courts, only for the reason that Taxation / Economic Legislation, by their very nature, are very complex. And hold on, the Regime of Property Tax based on Capital Value of the Property, was brought in force, on the recommendations of Tata Institute of “Social Sciences”. (Para 33 of the Judgment) Did these Social Scientist, nevertheless very respectable, would appreciate an Inch of what was discussed in 310 Pages of Judgment, even assuming t...
